This article discusses the legal context in which federal courts get involved in the arbitration process between representatives of employees and employers governed by the National Labor Relations Act, and then the law concerning judicial review of arbitrators' decisions. Courts may become involved in arbitrations at various stages of the process. It is the responsibility of courts to determine whether a union and employer have agreed to arbitration. The article considers what level of review is appropriate for arbitrators awards being reviewed by courts, concluding that judicial deference for arbitrators' awards is desirable and is to be encouraged.
