This article analyzes the Supreme Court's interpretation on the applicability of Title VII's anti-discimination mandate to American employees working for American companies in overseas offices. The equal employment rights of Americans working abroad are especially significant for the contemporary global workforce. Recent decisions recognize protections for this class of workers to the extent no conflict exists with local laws. This extension of U.S. law accords with international treaties, conventions, as well as European Union and national laws, recognizing equal employment as a basic human right. The article concludes that Title VII should be amended to apply broadly in these cases, to both U.S. citizens as well as those who are permanent U.S. residents when they are employed by American companies overseas. Extraterritorial application of Title VII to permanent residents employed by an American company abroad is consistent with the laws and principles of equal treatment and nondiscrimination.
